PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first and second respondents to consider the petitioner's representation dated 29.02.2024 pending on its file and pass appropriate orders in accordance with law after affording the petitioner an opportunity of personal hearing within a 1/6

ORDER

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus to consider the petitioner's representation dated 29.02.2024 and pass orders.

2. Mr.N. Naveen Kumar, Government Advocate takes notice for the Respondents. In view of the consent expressed by the learned counsel appearing for either side, this petition is taken up for final disposal.

3. The case of the petitioner is that the petitioner is running a firm M/s Boom cars which involves in the act of buying and selling pre-owned vehicles. The sum and substance of the case is that the petitioner sold a car "Ford Mustang Gt 5.0L vehicle bearing Registration No.09 CR 9097 2/6

to one Sanjay Kumar Easunathan for a sum of Rs.67,00,000/-. Subsequently the said Sanjay Kumar Easunathan returned the car to the petitioner and inturn the petitioner also paid a sum of Rs.60,00,000/-. Due to the said transaction the petitioner became the owner of the alleged car. When this being the case the mother of the Sanjay Kumar Easunatham had registered a complaint stating that the entire consideration of the car has not been paid and requested to blacklist the car and subsequently the said car has been blacklisted. Hence, the petitioner has given a complaint to the first and second respondents on 29.02.2024 regarding the said issue. However, till date there was no progress in the petitioner's representation. Hence this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the first and second respondents to consider the petitioner's representation dated 29.02.2024 and pass orders.

5. The learned Government Advocate appearing for the respondents 3/6

submitted that they will consider the case of the petitioner and take action in the manner known to law.

Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without going into the merits of the case, directs the first and second respondents to consider the petitioner's representation dated 29.02.2024 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

7. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
