ORDER
The petitioner apprehends arrest for the alleged offences under Sections 87 of BNS, and 5 (m), 5 (l) and 5 (j) ii, 6 of POCSO Act, in Crime No.10 of 2026 on the file of the respondent police seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is approximately 70 years old and the victim is aged about 17 years of age. On 19.09.2025, at about 7.00 p.m. while the victim and her friend were visiting the petitioner's house, he sexually assaulted the victim girl. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed to grant anticipatory bail to the petitioner.
5.Though the petitioner is aged about seventy years, considering the seriousness of the allegation, this Court is of the view that if the petitioner is enlarged on anticipatory bail, it would affect the moral fibre of the society. Hence, this is not a fit case to enlarge the petitioner on anticipatory bail.
