Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records of the first respondent relating to the public notice in Advt.No.UB/02(02)2010 dated 19.02.2010 and quash the same in so far as it is inconsistent with the provisions made in UGC (Minimum Standards and Procedure for Awards of M.Phil/Ph.D degree) Regulations, 2009, which was issued in exercise of powers conferred under University Grants Commission Act, 1956, relating to the admission of candidates to Ph.D course and consequently direct the 5th and 6th respondents to accept the M.Tech qualification of the petitioner acquired from the 4th respondent through distance mode of education and to admit him to Ph.D for the year 2010 session.

ORDER
The petitioner has come up with the present writ petition, challenging the public notice issued by the first respondent with regard to the admission of candidates in Ph.D. Course and for consequential relief.
2.Heard the leaned counsel appearing for the parties and perused the materials placed before this Court. 3.This Court is of the opinion that since the prayer sought for by the petitioner and the issue involved herein had already been clarified by the Supreme Court in a batch of cases in MA.Nos.1795 - 1796 of 2017 in Civil Appeal Nos.17869 - 17870 of 2017 vide order dated 03.11.2017, nothing survives for adjudication in this matter. 4.Hence, the writ petition is dismissed as having become infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
