Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the second respondent to dispose of the appeal in regarding cancellation of patta and separate patta in favour of the petitioner in respect of Survey No.357/1A3 to an extent of 0.09.5 acres situated at Madura Kammavarpalayam, Sholavaram, Chennai - 600 067, within a time frame manner. O R D E R
Heard Mr.M.Saravanakumar, learned counsel for the petitioner; Mr.V.Shanmuga Sundar, learned Special Government Pleader for the respondents 1 to 4 and perused the materials available on record. Despite notice, the respondents 5 and 6 have not chosen to appear in this case.
2. The petitioner has come forward with this Writ Petition seeking direction to the second respondent to dispose of the appeal preferred against the order of the fourth respondent.
3. The petitioner would state that she is the absolute owner of the property measuring an extent of 0.09.5 acres in Survey No.357/1A3 of Madura Kammavarpalayam, Sholavaram, Chennai. While granting patta under UDR Scheme, which was wrongly issued in the name of the private respondents. Hence, she preferred an appeal on 18.12.2012. Though the enquiry was conducted in the year 2013, but so far, no order has been passed.
4. Considering the prayer sought for in the Writ Petition and the facts of the case, this Court without going into the merits of the case, directs the second respondent to dispose of the appeal of the petitioner, on merits and in accordance with law, as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition is disposed of. There is no order as to costs.
