ORDER
This Writ Petition has been filed for a direction, directing the respondents 1 and 2 to provide police protection to the petitioner and his family and also to his business property building with ground floor, 1st floor and 2nd floor which is located at Plot Nos.1/6 and 1/7 to an extent of 4,800 sq.ft., building Bazar Road (Opp.to MMM Hospital), Mogappair East, Chennai due to continuous life threat and danger based on the petitioners complaint dated 11.05.2026 which is pending till date before the 1st respondent to investigate the same. 2.It is seen that the petitioner is a sub tenant to one Vanithakumari, who is the original tenant of the 3rd respondent. The subject premises is owned by the 3rd respondent.
Already 3rd respondent filed an eviction petition as against the original tenant and it was ordered and the Execution Petition is also pending. In the meantime, there is a money transaction between the petitioner and the 3rd respondent, for which, the petitioner also approached the Civil Court for recovery of money along with injunction prayer in O.S.No.
adjudication without any interim orders. However, the petitioner failed to obtain injunction order before the Civil Court. Now the petitioner seeks police protection to him and for his business. The Civil Court, now, seized of the matter in respect of possession of the said property, now the prayer sought for in the writ petition cannot be considered seeking police protection to the petitioner and to the building with ground floor, 1st floor and 2nd floor which is located at Plot Nos.1/6 and 1/7 to an extent of 4,800 sq.ft., building Bazar Road (Opp.to MMM Hospital), Mogappair East, Chennai.
3.In view of the above, this Court considers that this petition is devoid of merit and is liable to be dismissed.
4.In the result, this Writ Petition stands dismissed. However, the petitioner is granted liberty to approach the Civil Court for appropriate relief. No costs.
