2. Heard the learned counsel for the petitioner. Though notice serviced on the respondent and his name being printed in the cause list, there is no representation for him either in person or through counsel today when the matter is called.

3. Considering the submissions made by the learned counsel for the petitioner and on being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this Court is inclined to condone the delay of 9 days in filing the above CMA.

4. Accordingly, the delay is condoned and the petition stands allowed.
