O R D E R

The petitioner herein has sought for permission of the second respondent to disconnect the overhead line temporarily for a period of 6 to 7 hours on a particular day during digging operation of the bore well.

2. According to the petitioner the place chosen for digging the well, there is a wire line crossing. Therefore, the authorities to disconnect the power supply temporarily for a period of 6 or 7 hours in any particular day to complete the bore well digging operation.

However, though some representations made by the third respondent, the authorities have not considered the application and no order has been passed on his representation dated 02.05.2019, till date. https://hcservices.ecourts.gov.in/hcservices/

After notice, the learned counsel appearing for the respondents 1 and 2 would submit that the apprehension of the third respondent is that if the power supply is stopped, the agricultural activities of the land will be affected for nearly 6 or 7 hours. The petitioner submitted that he needs disconnection of power supply for 6 or 7 hours, so that there will not be any danger to the persons to dig the bore well. The petitioner has filed a Memorandum of undertaking intimation the date on which he could arrange for bore well.

4. Accordingly, a Memorandum filed stating that it will be convenient for him if the power supply stopped on 27.07.2019 and 28.07.2019 or on 06.08.2019 or 07.08.2019.

5. Recording the same, the writ petition is disposed of with a direction to the petitioner to give his letter stating the convenient date to arrange for digging the bore well. On receipt of such representation, the respondents 1 and 2 shall fix any convenient date and intimate the petitioner. No costs.
