The petitioner seeks leave to file an appeal against the order of the writ Court made in W.P.No.22729 of 2014, in and by which, the writ Court had directed regularization of the casual laborers as per the G.O.Ms.No.44 dated 30.04.2012 in the ratio of 75:25 in all group C posts.

2. Pursuant to the directions issued by this Court, the Government of Puducherry has taken steps to regularize those persons who would be entitled to regularization as per the Government Order. An affidavit has been filed by the Principal-cum-Programme Coordinator of the 1st respondent, wherein, it is stated that the petitioner's name figures in the list of employees, who are entitled to regularization. He could not be regularized due to want of vacancy. As of today the petitioner's name is at the 93rd position. As per the Government Order applying 75:25 ratio there are 87 clear vacancies in the cadre of Mazdoors and the first 87 persons in the list have been regularized. Therefore, the petitioner's service will also be regularized as and when his turn comes.

In response to the contention of the learned counsel for the petitioner that certain persons who have deserted the service have also been regularized, it is stated that action will be taken against those persons after hearing them and if any of them are found unfit, their services will be terminated and other persons in the waiting list will be absorbed in their places.

4. In view of the said statement, we do not think we can grant leave to the petitioner to file appeal against the order of the Single Judge, which is actually in favour of the petitioner. Hence, this petition is dismissed. It is made clear that the respondents will take steps to regularize the employees found in the original list as and when vacancies arise. (R.S.M., J.)
