The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 342, 366A, 370A, 372, 373 of IPC and 3(2)a, 4(1), 5(1)a, 5(1)b, 5(1)c, 6(2-A), r/w 6(1) of ITP Act and 5(1), 5(p), 6 r/w 17 of POCSO Act, in Crime No.16 of 2024 on the file of respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons indulged in trafficking of minor girls and transacted money. Further, the petitioner taken one of the victim to Hyderabad where the victim was sexually abused by unknown person in hotel and also in other places. Hence, the case.
3. The learned counsel for the petitioner would submit that this is the second anticipatory bail petition, and the petitioner has not committed any offence as alleged by the prosecution. He further submit that the petitioner is the wife of A2, and she was falsely implicated as if she associated with her husband in trafficking of minor girls. 4. The learned Government Advocate (Crl. Side) appearing for respondent would raised serious objection stating that the petitioner was involved in trafficking of minor girls and they were sexually abused by them. Further the statement of the victim girl was recorded, wherein she stated that she was taken to Hyderabad and sexually abused. He would further submit that the investigation is still pending.
5. Considering the above fact and circumstances of the case and the submissions made by both the counsels and also on considering the gravity of offence committed by the petitioner and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
