Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, forbearing respondents 1 and 2 from taking into account the 8 memos of respondents against the petitioner viz., Memos dated 19.04.2013 in Na.Ka.No.Ac-III/TSP-8, dated 28.11.2013 in Na.Ka.105/AcII/TSP-8, and dated 28.11.2013 in Na.Ka.107/Ac-II/TSP-8, of the 4th respondent, Memos dated 03.04.2013 in C.No.20/ACI/TSP8 and dated 22.11.2013 in Na.Ka.47/DC/TSP8 of the 5th respondent, Memo dated 03.04.2013 in No.19/ACII/TSP8 of the 6th respondent and Memo dated 21.10.2013 in Na.Ka.44/SACI/TSP8 of the 7th respondent and Memo dated 07.11.2013 bearing no reference number of the 8th respondent, while considering petitioner's promotion to the post of Inspector of Police from the list of 1988 list of SubInspectors of Police. This writ petition has been filed to forbear the respondents 1 and 2 from taking into account the 8 memos issued against the petitioner while considering his promotion to the post of Inspector of Police from the 1988 list of SubInspectors of Police. 2.
Upon notice, the respondents filed a counter affidavit wherein in para 8, it is stated that the petitioner was habitually involving in indifferent activities against the disciplinary rules and regulations and hence, he was issued with the memos referred to in the writ petition as a routine procedure to set right his lapses in duties and not to spoil his future promotion. It is further stated therein that subsequent to the aforesaid memos, no proceedings have been initiated against the petitioner and he retired from service on attaining the age of superannuation.

In view of the specific averments made in the counter affidavit, this Court is of the opinion that nothing survives for adjudication in this writ petition. Hence, the writ petition is dismissed as infructuous. No costs. Consequently connected miscellaneous petition is closed.
