ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1st respondent to accord sanction for conducting prayers in the 6th and 7th respondents Mosques during the Bakrid festival scheduled on 07.06.2025. 2.Heard Mr.A.Raja Mohamed, learned counsel appearing on behalf of the petitioner, Mr.Mohamed Fayaz Ali, learned Standing Counsel appearing on behalf of respondents 1 & 4, Mr.V.P.R.Elamparithi, learned Additional Government Pleader appearing on behalf of the 2nd respondent and Mr.Leonard Arul Joseph Selvam, learned Government Advocate (Criminal Side) appearing on behalf of the 3rd respondent.

4/7 3.The learned Standing Counsel appearing on behalf of the Tamil Nadu Waqf Board submitted that the petitioner Society has filed this writ petition on an apprehension that the 6th and 7th respondents Mosques is going to be closed and whereas, clear instructions have been given to keep the mosques open in order to enable performing prayers during Bakrid. 4.The learned counsel for the petitioner submitted that even though the Waqf Board has given such instructions, the 5th respondent is attempting to close the Mosques and is preventing from performing the prayer during Bakrid. 5.On carefully considering the submissions made on either side and considering the materials available on record and also taking note of the earlier orders passed by this Court, it is seen that every time during Bakrid and Ramzan, the petitioner approaches this Court and pursuant to the directions issued by this Court, the prayers are conducted. Hence, a similar direction can be issued in the present writ petition also.

5/7 6.In the light of the above discussion, there shall be a direction to the 1st respondent to ensure that the Mosques are kept open and all are permitted to participate in the prayer and if any law and order problem is created, the 3rd respondent shall ensure that proper protection is given and the entire festival goes on peacefully.
