PRAYER: This Criminal Original Petition is filed under Section 482 of Code of Criminal Procedure to direct the respondents not to harass the petitioner and direct the 1st respondent to handover the cheque which was forcibly obtained by the 2nd respondent.

ORDER

This criminal original petition has been filed seeking a direction to the respondents not to harass the petitioner and direct the 1st respondent to handover the cheque which was forcibly obtained by the 2nd respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that this petitioner lodged a complaint dated 08.07.2016 in respect of purely civil transactions with one Suresh Kumar Jain. Based on the complaint, petition enquiry in CSR No.381 of 2016 was conducted and the same was closed. It is alleged by the petitioner that one Suresh Kumar Jain has given a complaint against this petitioner, based on which, petition enquiry is pending.

4. The learned Additional Public Prosecutor submitted that Suresh Kumar Jain has not given any fresh complaint to the respondent police.

Recording the same, the criminal original petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
