Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records of the Respondent in Pa.Mu.30005/2015AM3 dated 15.03.2017 and quash the same and consequently direct the Respondent to renew RIFLE gun licence R-643/390 to the Petitioner.

O R D E R

When it was pointed out by the Learned Additional Government Pleader appearing for the Respondent that the Petitioner has got an effective alternative remedy under Section 18 of the Arms Act, 1959, read with Rules 105 to 107 of the Arms Rules, 2016, to challenge the impugned order and seek other consequential relief, Learned Counsel for the Petitioner seeks permission of this court to withdraw the Writ Petition with liberty to resort to the same and he has made an endorsement to that effect, which is recorded.

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. The time spent by the Petitioner in prosecuting this Writ Petition from the date of its filing (04.07.2019) till the date of receipt of copy of this order, shall stand excluded while calculating the period of limitation for filing appeal before the Appellate Authority. It is needless to add here that if such an appeal is filed and is otherwise in order, the Appellate Authority after affording full opportunity https://hcservices.ecourts.gov.in/hcservices/

of hearing to the parties concerned in consonance with the principles of natural justice and the prescribed procedure shall consider the each of the contentions raised by them in such appeal and pass a reasoned order on merits in accordance with law and communicate the decision taken to them. Consequently, connected Miscellaneous Petition is also closed. No costs.
