Heard the Learned Counsel for the petitioner and the Learned Counsel for the respondents.
2. The petitioner herein has filed this Writ Petition seeking Writ of Mandamus to direct the 1st respondent to consider his application for renewal of recognition.
3. The case of the petitioner is that, the Institute was started in the year 1982 and till 2011 the respondent has recognised the Institute. Thereafter, the application for renewal is pending and not considered by the respondents for various reasons. Whereas, the Learned Government Advocate appearing for the respondents would submit that, the petitioner Institute did not satisfy the necessary infrastructure requirements for granting recognition and therefore, after due inspection, show cause notice was issued to the Institute on 11.04.2011, why the Institute should not be closed.
4. Despite show cause notice, the petitioner Institute did not rectify the defects and deficiencies in the Institute. Hence, the 1st respondent vide communication dated 31.05.2011, refused to grant the recognition to the petitioner Institute. However, taking note of the students who were perusing their studies in the petitioner Institute, in the interest of those students, recognition for the Institute from L.K.G to 8th standard for the period from 01.06.2008 to 31.05.2011 was granted and thereafter, the petitioner Institute not been recognised and they are running the Institute without recognition. If the petitioner Institute needs recognition, they have to apply afresh for recognition.
5. In view of the above facts, the Writ Petition is disposed, with liberty to the Writ Petitioner to make application afresh for recognition. If the petitioner submits the application with all required documents, the respondents shall consider the same and pass orders, within a period of six weeks, from the date of receipt of the application.
