ORDER

(The case has been heard through video conference) The petitioners, who were arrested and remanded to judicial custody on 12.09.2020 for the offence punishable under Sections 341, 294(b), 397 and 506(ii) of IPC in Crime No.1676/2020, on the file of the respondent police, seek bail.

2. The case of the prosecution as per the de facto complainant Rashidh is that on 11.09.2020, the accused, who are known to him, have demanded money for drinking and when he had refused to give money, they have attempted to cut him with knife. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocents and they have been falsely implicated in this case. He would submit that the first and second petitioners were arrested and remanded to judicial custody on 12.09.2020 and the third petitioner was produced on PT warrant. He would submit that as far as the second case in Crime No.113 of 2020, the third petitioner was originally arrested on 10.03.2020 and later, he was produced on PT warrant.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police would vehemently oppose stating that as far as the first petitioner Sathish @ Appu is concerned, he has got three previous cases, as far as the second petitioner is concerned, there are four previous cases and as far as the third petitioner Nisanth is concerned, he has got six previous cases. He would submit that the petitioners are notorious elements and that they have been creating problem in the area repeatedly.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Taking into consideration the fact that the petitioners are notorious elements and they got previous cases, this Court is not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed.
