PRAYER : Criminal Original Petitions filed under Section 482 of Criminal Procedure Code, to transfer the investigation registered the FIR in Crime No.443 of 2019 from the respondent police to any other investigating agency under the circumstance of the case.

O R D E R

This petition has been filed seeking for transfer of investigation in Crime No.443 of 2019 pending on the file of the respondent police.

2. The grievance of the petitioner is that in spite of the accused persons attacking the defacto complainant, the respondent police did not effect any arrest of the accused persons and they were left free and subsequently the accused persons obtained anticipatory bail before this Court. The further grievance of the petitioner is that the respondent police, instead of investigating and filing a final report, is forcing the petitioner to enter into compromise with the accused person.

3. Heard, the learned counsel for the petitioner and the learned Additional Public Prosecutor on behalf of the respondent police.

4. Taking into consideration the facts and circumstance of the case, the Assistant Commissioner of Police, Nungambakkam is directed to monitor the investigation conducted by the respondent police in Crime No.443 of 2019. The investigation shall be conducted effectively and a final report shall be filed within a period of three months from the date of receipt of copy of this order.

5. This Criminal Original Petition is disposed of accordingly.
