ORDER

This petition is filed to modify the condition imposed on petitioner in Para No.8(a) in Crl.OP.No.14366 of 2025, dated 08.05.2025, that the petitioner shall make a non-refundable deposit of Rs.20,000/- (Rupees Twenty Thousand Only) to the credit of Ray of Light Foundation, Account No.50100078904233, HDFC Bank, Babibullah Road, T.Nagar, Chennai IFSC Code - HDFC000164, within a period of two weeks from the date of receipt of the copy of the Order and shall produce the said receipt before the court below.

2. Learned counsel for the petitioner would submit that as per the Tamil Nadu Liquor (Possession for Personal Consumption) Rules, 1996, a person is entitled to have 4.5 liters of liquor in his possession. In this case, the petitioner was having only 2 Brandy bottles each containing 180 ml which is within the permissible limit. Learned counsel further submits that the petitioner runs a small petti shop, earning a meagre monthly income and to deposit a huge sum

of Rs.20,000/- is beyond his capacity and prays for modification of the aforesaid condition.

3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.

4. In view of the above submission, this Court modifies the conditions imposed on the petitioner in Crl.O.P.No.14366 of 2025 dated 08.05.2025 as follows:

i) Para 8 (a) is deleted;

ii) Para 8 (b) is modified to the effect that the petitioner shall report before the respondent police as and when required for interrogation. Further, the petitioner is directed to surrender and execute the surety as ordered by this Court on 08.05.2025 within a period of two weeks from the date on which the present order is made ready, failing which, the order passed by this court stands automatically cancelled. It is also made clear that all the other conditions shall remain unaltered.
