The petitioners, who were arrested and remanded to judicial custody on 03.03.2022 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29 (i) of NDPS Act in Crime No.46 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 03.03.2022, upon secret information, the respondent police found the petitioner and three others sitting under the tree holding a black colour carry bag. On enquiry, it was found that they were in possession of 21 Kgs of Ganja. Hence, the case.

3. There are totally five accused, in which the petitioners are arrayed as A1 and A2. All the accused persons were jointly possessing 21 Kgs of Ganja. It is a commercial quantity. That apart, the petitioners failed to fulfill the twin conditions as contemplated under Section 37 of the NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioners and this Criminal Original Petition is dismissed.
