ORDER

(Order of the Court was made by the Hon'ble Chief Justice) From the report filed by the seventh respondent, it is amply clear that number of deviations have still not been removed.

2. Learned counsel appearing for the owner would submit that they may be granted one last opportunity to remove the deviation, without affecting the undeviated part of the building as it is an educational institution and students are studying and also occupying hostels.

3. But for the fact that it is an educational institution, this Court would not have granted any indulgence whatsoever, anymore. In the larger interest of justice, we are inclined to grant thirty days' time, as prayed for by learned counsel for the owner/occupier, to set right all deviations.

4. After thirty days, the Commissioner shall ensure a fresh inspection to be carried out and submit his report before the Court, within next seven days thereafter.

5. List on 04.03.2026.

6. In view of the submission made that because of the judicial intervention and interim order passed by the learned Single Judge, the authority was under a bona fide opinion that no further action can be taken and therefore, inspection was not carried out, Rule is discharged. Presence of officer, Mr.S.Musthaba, Commissioner, Dharapuram Municipality, is exempted. The Commissioner has to be careful and cautious in the matter of compliance of order passed by this Court in future.
