This application has been filed by the applicants/defendants 1, 2, 4 to 8, 15, 16, 19, 27, 32, 34 to condone the delay of 182 days in filing the written statement of the first defendant and the adoption memo filed by the defendants 2, 4 to 8, 15, 16, 19, 27, 32, 34.
2. According to the applicants, they are the defendants 1, 2, 4 to 8, 15, 16, 19, 27, 32, 34 in the main Suit and the respondents 1 to 27/plaintiffs have filed the main Suit for the relief of the partition and separate possession. After receipt of summons from various dates by the defendants, draft written statements have been collected from the occupants of the plaint schedule property. There is a delay in the collection of documents from the families residing in the plaint schedule property. Therefore, there is a delay in filing the written statement. Hence, they filed this application.
3. The other side has not seriously objected.
4. Considering the reasons stated in the affidavit that due to the collection of documents, there is a delay of 182 days in filing the written statement and considering the facts and circumstances of the case, this application is allowed and the written statement is taken on file.
