This application is filed seeking to withdraw the suit in O.S.No.2087 of 2013 from the file of the learned XVI Assistant Judge, City Civil Court, Chennai and transfer the same to this Court and for trial along with C.S.No.257 of 2013.

2. Heard the learned counsel appearing on both sides. There is no serious objection for the withdrawal and transfer application being allowed.

3. As the plaintiff is the same and the defendants are different, let there be a simultaneous trial, but there should not be a joint trial.

4. Accordingly, this application is allowed.
