ORDER

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondent to pay the payment of difference amount of Surrender Leave salary and Gratuity along with interest of belated period and consider the petitioner's representation dated 18.04.2025.

The case of the petitioner is that he was appointed as Junior Assistant in the respondent Transport Corporation on 12.12.1979 and after completion of unblemished service, the petitioner had retired from service on 30.04.2017. Thereafter, the terminal benefits have been settled to the petitioner based on old basic salary and Grade pay, but in the case on hand, the petitioner is eligible for 7th Pay Commission. In view of the same, the petitioner submitted a representation dated 18.04.2025 to the respondent seeking to settle the difference of terminal benefits and interest, based on the 7th Pay Commission. Since the same was not considered, the present Writ Petition has been filed.

3. At this juncture, learned Standing Counsel appearing for the 2/4

respondent fairly submits that they would consider the petitioner's representation dated 18.04.2025 within a reasonable time.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel without going into the merits of the writ petition, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 18.04.2025 and pass order, within a period of six weeks from the date of receipt of a copy of this order on its own merits and in accordance with law.

In the result, the Writ Petition is disposed of with the above observations. No costs.
