Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, praying to punish the respondents for committing contempt of Court by disobeying the order passed by this Court in W.P.No.26039 of 2019 dated 15.06.2023.

O R D E R

(Order of the Court delivered by S.M.SUBRAMANIAM.J.,) With reference to the order of this Court dated 15.06.2023 passed in W.P.26039 of 2019, learned Special Government Pleader (HR&CE), would submit that survey was conducted and encroachments are identified in the temple properties. The petitioner himself is found to be an encroacher and action was initiated under Section 78 of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 [TN HR&CE Act]. The Original Authority passed final orders of eviction of encroachers on 08.07.2024. Encroachers preferred a revision before the Commissioner under Section 21 of TN HR&CE Act. The revision petition is now listed for hearing on 29.09.2025.

2. In view of the fact that action has already been initiated for eviction of encroachers from temple properties, the respondents have not committed any willful disobedience of the order of this Court dated 15.06.2023 in W.P.No.26039 of 2019. However, authorities shall ensure that encroachers Page No.3 of 5

are removed by following due procedure after disposal of the revision which is now pending before the Commissioner, Hindu Religious and Charitable Endowments Department.
