Petitions filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents to fix the basic pay of the petitioners on par with the basic pay fixed for the police personnel transferred from Tamilnadu
Special Police Establishment to the Coimbatore City Police by stepping up the basic pay of the petitionerr, herein respectively.
For Petitioners : Mr.M.Siva Varthanan For Respondents: Mr.A.N.Thambidurai, SGP in all WPs COMMON ORDER These writ petitions have been filed to direct the respondents to fix the basic pay of the petitioners on par with the basic pay fixed for the police personnel transferred from Tamil Nadu Special Police Establishment to the Coimbatore City Police.
2.According to the learned counsel for the petitioners, the petitioners joined the Police Department as Gr.II Constable and after periodical promotions, they were upgraded as Special Sub Inspector of Police and on reaching the age of superannuation, retired from service. It is their grievance that one Eswaran and 24 others, who were working in Tamil Nadu Special Police Establishment and were promoted as Head Constable in the year 2000, were fixed in the basic pay of Rs.5800/-, whereas the petitioners, who were promoted as Head Constables prior to those persons, were fixed in the basic pay of Rs.4000/-. In this regard, the petitioners made representation to the respondents to refix their basic pay on par with their juniors, which was not considered, till date. Hence, these writ petitions. 3.
On the other hand, the learned Special Government Pleader appearing for the respondents fairly submitted that in the event of the petitioners being made fresh representation, the same would be considered by the respondents and appropriate orders be passed, on merits, within a time frame to be stipulated by this Court.
4.The submission so made by the learned Special Government Pleader appearing for the respondents has been agreed upon by the learned counsel for the petitioners.
5.Considering the facts and circumstances of the case and having regard to the submissions so made by the learned counsel on either side, this Court directs the petitioners to submit fresh representation highlighting all the points in support of their claim, to the respondents within a period of three weeks from the date of receipt of a copy of this order. On such submission, the respondents shall consider the same and pass appropriate orders on merits and in accordance with law, within a period of four weeks thereafter.
6.Accordingly, these writ petitions stand disposed of. No costs.
