S.Velkumar v. The Central Information Commissioner

2023-12-07Honourable Mr Justice P.D.Audikesavalu3 pages

N.SESHASAYEE, J., This case is posted under the caption 'for being mentioned' at the instance of both sides.

2. The learned counsel for the petitioner submitted that while the causetitle of the present case is rightly given, the contents in the body of the order reflects the facts of another case in W.P.No.19661 of 2023.

3. This Court perused the papers and realises that there is a major error in passing the order. Indeed the petitioner had filed two separate petitions in W.P.No.19659 of 2023 (the present case) and W.P.No.19661 of 2023. Both relate to certain information which the petitioner requires from the Central Public Information Officer, but the details so required pertains to different departments. Some error appeared to have been occasioned when the Personal Assistant concerned had typed the order. And this Court also may have to take part of the blame as it had signed the order without meticulously going through the facts of the case.

4. In view of the same, it is only appropriate that this Court recalls the 1/3

entire order dated 07.08.2023 passed in the present petition, and also its subsequent order dated 24.01.2024.

5. Registry is now required to post the matter before the concerned Court which holds portfolio relating to this matter. 14.03.2024 ds 2/3
