JUDGMENT

The above Testamentary Original Suit was referred to the Tamil Nadu Mediation & Conciliation Centre, High Court, Madras and before the Mediator appointed by this Court, the parties have arrived at a Joint Memorandum of Compromise.

2. A plan demarcated with the respective portions allotted to the plaintiff and defendants 1 to 3 is annexed along with the Joint Memorandum of Compromise which shall form part and parcel of the Joint Memorandum of Compromise.

3. In view of the evidence available on record, I am satisfied with the due execution and attestation of the Will dated 21.06.1978 and it is proved in accordance with law. Accordingly, the Testamentary Original Suit is decreed in terms of the Joint Memorandum of Compromise which shall form part and parcel of the decree.

4. In view of the grant of Letters of Administration, the plaintiff in the Testamentary Original Suit shall execute a bond for a sum of Rs.25,000/-

before the II Assistant Registrar, Original Side, within a period of eight weeks from today. Thereafter, the Registry shall issue the Letters of Administration annexing the Joint Memorandum of Compromise, along with the plan, to the plaintiff.
