The petition is filed to condone the delay of 197 days in preferring the Appeal.

2.Heard both sides.

3.The complaint of the appellant/petitioner for the offence under Section 138 of Negotiable Instruments Act was transferred to another Court and was taken up. However, the said transfer was not intimated to the appellant, hence, he did not enter appearance. As a result, the complaint came to be dismissed for default. The accused was acquitted. He has now filed the appeal after coming to know all these.

4.Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay of 197 days in preferring the Appeal is condoned and accordingly, this petition is allowed.
