ORDER
The defendants have filed this application to condone the delay of 89 days in filing the written statement. In paragraph 6 thereof, it is stated that the defendants had to respond to the allegations in the plaint by collecting necessary documents and had to defend the interim applications.
2. Learned counsel for the plaintiff has no serious objection to this application being allowed.
3. Upon examining the reasons set out in the affidavit and being satisfied that sufficient cause is shown, this application is allowed as prayed for. Consequently, the Registry is directed to receive the written statement of the defendants.
4. It is no longer open to the defendants to contend that suit summons was not served.
