Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to measure and demarcate the petitioner's property measuring an extent of 3.35 acres situate in New S.F.NO.143/2 bearing patta No.351 of Kannantheri Village, Sankagiri Taluk as per the title documents and revenue records on petitioner's application dated 04.02.2016 to the 4th respondent and petitioner's representation dated 14.03.2016 to the respondents 1 to 3. ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner claims to have purchased the landed property, totalling to an extent of 3.35 acres in old SF.No.143, new SF No.143/2, through registered Sale Deeds dated 20.03.1974, 07.02.1981, bearing Document Nos.435/1974 and 164/1981, registered on the file of the office of the Sub Registrar, Magudanchavadi and the petitioner had also been issued with a patta bearing No.351 in respect of the land in SF.No.143/2. The petitioner require his lands to be surveyed

and boundaries to be demarcated. In this regard, he has submitted an application dated 04.02.2016 to the 4th respondent to survey and measure the land and has also paid the necessary fees on the same day and despite that, no orders have been passed and therefore, the petitioner came forward to file the present writ petition.

The learned counsel for the petitioner would submit that the petitioner in this regard has also submitted a representation dated 14.03.2016 to the respondents 1 to 3 and though it was received and acknowledged, the respondents are yet to respond to the same and therefore, the petitioner is constrained to file this writ petition.

Heard the submissions of Mr.R.Govindasamy, learned Special Government Pleader who accepts notice on behalf of the respondents.

Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the same, directs the 4th respondent to dispose of the petitioner's application dated 04.02.2016 and the representation dated 14.03.2016 on merits and in accordance with law, after putting on notice, the person/s concerned and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the person/s concerned. The writ petition is disposed of with the above direction. No costs.
