CMP.NO. 203/2014 ...RESPONDENTS Prayer : Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to withdraw and transfer the pending H.M.O.P. NO.49 of 2013 from the file of the Subordinate Court, Perundurai, Erode District to the file of Family Court, Chennai City, Chennai Division.
Order : This petition coming on for orders in the presence of Mr.P.Kalimuthu, Advocate for the Petitioner, and of M/s.P.T.Ramadevi, Advocate for the 1st Respondent, and of Mrs.Akila Rajendran, Government Advocate for the Respondents 2 and 5, and of Mr.A.Durai Eswar, Advocate for the 3rd Respondent, and of Mrs.V.Nalini, Advocate for the 6th Respondent, and of Mr.R.Y.George Williams, Amicus Curiae, the Court made the following order;- This Transfer Civil Miscellaneous Petition has been filed seeking transfer of HMOP.NO.49 of 2013 pending on the file of learned Subordinate Judge, Perundurai, Erode District to the file of Family Court, Chennai. After hearing both sides, this court by order dated 16.06.2015 disposed of the Tr.CMP., granting the relief as sought for by the Petitioner/wife.
The operative portion of the order is found in paragraph 6 and is as follows:- "6. Accordingly, HMOP.No.49 of 2013 pending on the file of Sub Court, Perundurai, Erode, is transferred to Family Court, Chennai. The Subordinate Judge, Perundurai, is directed to forward the case bundles pertaining to the case to Family Court, Chennai."
2. This court, impleaded Secretary, Law Department, Government of Tamil Nadu, Fort St.George, Chennai, and the Registrar General, High Court, Madras, and sought for certain details as follows:- "1. Number of cases filed each year for the past ten years in Family Court at Chennai.
2. How many cases are disposed of every year ?
3. How many cases are conciliated and compromised every year ?
4. Whether the existing courts are sufficient to handle the cases being filed ? 5. If not, how many additional courts are necessary based on the rate of filing and pendency of cases ?
6. Whether sufficient infrastructures are available in the Family Courts at Chennai ?
7. What are all the other problems faced by the judicial officers while dealing with the parties and advocates ?
8. Whether the present staff strength of the courts are sufficient ?
9. Is there any necessity for appointment of more number of counselors or counselling centres in Family Court at Chennai ?
10.What are all the suggestions of the respondents to enable the Court to dispose of the Family Court Cases at the earliest ?"
3. Today, when the matter is taken up for hearing, Mr. R.Y.George Williams, Amicus Curiae submitted that report enclosing list of cases pending before Family Courts in Chennai, has been filed. The said report is taken on record and the report is directed to be placed before the Committee for Senitisation of Family Court matters.
