This application is filed to condone the delay of 1371 days in filing the written statement of the 8th defendant.

Learned counsel for the applicant/8th defendant submits that the written statement was not filed as no summons was served in that address of service was wrongly given in the plaint and that is one reason why the summons was not served on the 8th defendant. He further added that the 8th defendant came to know about the institution of the suit from the 2nd defendant only in the second week of August, 2021.

Heard the learned counsel for the plaintiff.

This Court is satisfied with the reasons stated in the accompanying affidavit. Delay is condoned and application No. 4076 of 2021 is allowed.
