Respondents Petition under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 1st respondent to conduct enquiry, on the basis of representation dated 28.04.2022 given by the petitioner against 5th to 7th respondents herein and recover the properties of the Kailasanathar Temple situated at Kailasapuram, Near Junction, Tirunelveli District and also collect rent as per the present market value from date on which lease period lapses.

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) Mr.M.Stalin, S/o Murugesan has filed this Public Interest Litigation petition to direct the first respondent to conduct enquiry, on the basis of the representation dated 28.04.2022 given against the respondents 5 to 7 herein,

and recover the properties of the Kailasanathar Temple situated at Kailasapuram, Near Junction, Tirunelveli District and also collect rent as per the present market value from date on which the lease period lapses.

2. When the matter was taken up, learned counsel appearing for the petitioner fairly submitted that since the Assistant Commissioner, Hindu Religious and Charitable Endowments Department, Tirunelveli has filed the report dated 16.08.2022 to the Commissioner, Hindu Religious and Charitable Endowments Department, Chennai, the learned counsel sought for liberty to question the same legally.
