Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to grant monetary and promotional benefits to the petitioner by cancelling the punishment imposed on the petitioner in the light of judgment passed in STC No.1313 of 2012 dated 05.04.2018 based on the petitioner's representation dated 28.07.2021.

This Writ Petition has been filed for direction directing the respondents to grant monetary and promotional benefits by cancelling the punishment imposed on the petitioner in the light of the Judgment passed in STC No.1313 of 2012 dated 05.04.2018, thereby acquitted the petitioner from the criminal charges.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner, while he was working as a driver, had met with an accident on 22.08.2012. Therefore, he was arrested and remanded to judicial custody. He was deemed to be suspended from service. In the disciplinary proceedings, he was imposed punishment by an order dated 26.09.2013, thereby imposed punishment of stoppage of increment for two years with cumulative effect. Now the petitioner submitted a representation seeking monetary benefits in the light of the acquittal order passed by the Trial Court in STC No.1313 of 2012 dated 05.04.2018. Hence, this Writ petition.

4. Admittedly, the petitioner failed to challenge the order of 2/4

punishment imposed on him. Without challenging the order of punishment, the petitioner submitted a representation seeking monetary and promotional benefits.

5. In view of the above, the request made by the petitioner cannot be considered. Thus, the writ petition itself is devoid of merits and is liable to be dismissed.
