This petition has been filed to condone the delay of 161 days in filing the petition for setting aside the order dated 20.09.2023 made in S.A.No.770 of 2018.

2. The learned counsel appearing for the respondent would seek time to file counter.

3. Considering the fact that this application is only to condone the delay in filing the petition to set aside the order, he would be having chances of filing a counter in the restoration petition. Accordingly, being satisfied with the reasons assigned in the affidavit filed in support of this petition, this petition is ordered.

4. The Registry is directed to number the application to restore the second appeal.
