(Order of the Court was made by N.KIRUBAKARAN,J.) As per the earlier order, a total amount of Rs.70,60,000/- has to be paid to the appellant. Out of the said amount, Rs.1,00,000/- was paid through cheque on 25.09.2006 and Rs.24,60,000/- has already been deposited in Fixed Deposit in Indian Bank, High Court of Madras by the respondent. Apart from the above amounts, a sum of Rs.45,00,000/- was agreed to be paid by the respondent on or before 31.10.2017, out of which a sum of Rs.20,00,000/- alone had been paid on 25.10.2017 vide cheque No.811167 of Indian Bank, Pallikaranai Branch in favour of the appellant.

2.However, with a delay the balance amount of Rs.25,00,000/- vide Cheque No.811175 dated 23.07.2019 drawn on Indian Bank, Pallikaranai Branch is paid today, by taking out this petition seeking extension of time. This petition is ordered as the appellant has got no objection. The amount of Rs.24,60,000/- which has been deposited in Fixed Deposit in the Indian Bank, High Court of Madras shall be paid to

the appellant with accrued interest for which the respondent has also got no objection. The said bank ABDUL QUDDHOSE, J.

This matter has been brought before this Court by way of being mentioned stating that eventhough the petitioner in the Miscellaneous Petition is the respondent in the appeal, it has been wrongly mentioned as petitioner/appellant and eventhough the respondent in the Miscellaneous Petition is the appellant in the Appeal, it has been wrongly mentioned as respondent/respondent in the cause title of the order passed by this Court on 07.08.2019 in C.M.P.No.15471 of 2019 in O.S.A.No.67 of 2012.

2.Therefore, the cause title of the order passed in C.M.P.No.15471 of 2019 in O.S.A.No.67 of 2012 dated 07.08.2019 has to be corrected as follows: "N.Balasubramaniam Petitioner/Respondent Vs.

D.Rajeswari Respondent/Appellant"

3.The Registry is directed to issue cheque to the appellant as per the order passed by this Court on 07.08.2019, within a period of one week from the date of receipt of a copy of this order. Post the matter on 17.02.2020. (N.K.K,J) (T.K.R,J) 14.02.2020 sai The Registry is directed to issue fresh order copy after carry out the necessary correction.
