ORDER

The present Writ Petition is filed seeking for a Writ of Mandamus, to direct the respondents 3 and 4 to consider the petitioner's representations dated 12.12.2024, 17.12.2024 and 03.02.2025 and to initiate criminal prosecution against the 11th to 18th respondents for their criminal acts of registration of false and fabricated document, including impersonation and to commence criminal prosecution as per Sections 81A, 82 and 83 of the Registration Act, along with relevant provisions of the IPC or BNS Act.

2. It is the case of the petitioner that she submitted representations on 12.12.2024, 17.12.2024 and 03.02.2025 before the official respondents, however, the same was not considered till date. Therefore, petitioner has approached this Court by way of this writ petition. Page No.3 of 7

At the outset, it is submitted by the respective learned Government Advocate appearing for the Official respondents that the petitioner's representations dated 12.12.2024, 17.12.2024 and 03.02.2025 would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration of the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents 3 and 4, to consider the representations dated 12.12.2024, 17.12.2024 and 03.02.2025 made by the petitioner on its own merits, keeping in view the relevant provisions under the Registration Act. The respondent may as a preliminary issue, examine maintainability/legality of the request made by the petitioner in her representations. If found maintainable, the respondent would then proceed to examine the representation and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner as well as to the respondents 11 to 18 and other parties, if any, within a period of sixteen weeks from the date of uploading of web copy of the order without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representations and it is open to the Page No.4 of 7

concerned respondents to consider the representations on its own merits and in accordance with law.
