Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the first respondent not to harass the petitioners under the guise of enquiry of the false and frivolous complaint of 2nd respondent, since the same is clearly a matrimonial dispute and also further direct the first respondent police not to harass, abuse or threaten the petitioners in any manner with regard to the aforesaid complaint.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the first respondent not to harass the petitioners under the guise of enquiry, on the false and frivolous complaint given by the 2nd respondent.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the first respondent.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that there is no complaint pending against the petitioners before the respondent-police. However, a complaint is pending against the petitioners before the Inspector of Police, W-21, All https://hcservices.ecourts.gov.in/hcservices/

Women Police Station, Guindy, on the complaint given by one Rajalakshmi.

4. Under such circumstances, blanket order of 'not to harass' cannot be passed. The petitioners shall co-operate for the enquiry and during the course of enquiry, they shall not be harassed. However, if any cognizable offence is made out, this order would not be a shield against the arrest of the accused.

With the above observation, the Criminal Original Petition is closed.
