O R D E R

This Civil Revision Petition has been filed for a direction to the learned Principal District Judge, Chengalpattu to dispose of the suit in O.S.No.283 of 2019 within the stipulated time that may be fixed by this Court.

2. The case of the petitioner is that the petitioner herein is the plaintiff and the respondents herein are the defendants. The petitioner has filed a suit in O.S.No.283 of 2019 on the file of the Principal District Judge, Chengalpattu, to direct the defendants to pay a sum of Rs.17,24,500/- jointly and severally.

3. The learned counsel for the petitioner submitted that the petitioner/plaintiff had been appointed as General Manager vide letter of 2/6

appointment dated 08.09.2012 issued by the defendant. During the course of employment, the petitioner had proceeded on his two wheeler towards the defendant's factory, while he was travelling near Arcot Road at Alwarthirunagar, Kamarajar Salai one Innova car, which drove in a rash and negligent manner, had hit the petitioner's vehicle. As a result of the accident, the petitioner had sustained grievous injuries. He further submitted that the respondents has no medical insurance coverage for its employees and the petitioner's had spent around Rs.2,68,955/- towards medical expenses and the respondents are not ready to the same. All of a sudden, in the month of January 2016, the respondents had disbursed a sum of Rs.43,070/- as salary, whereas the petitioner original salary was a sum of Rs.70,000/- per month.

When he requested the respondents to release the remaining salary for that month and for the subsequent months till 30.06.2019, there was no response. Hence, the petitioner has filed a suit in O.S.No.283 of 2019 before the Principal District Judge, Chengalpattu for the claim of Rs.17,24,500/- towards unpaid salary along with interest.

4. The case of the petitioner is that the said suit is pending from the year 2019 and the respondents/defendants had chose to file their written 3/6

statement only after a lapse of two years and the trial Court is adjourning the case from time to time though there are several applications had been pending. Further, the respondents are trying to alienate the company though an I.A is pending from the year 2019 towards furnishing security. Hence, the petitioner has filed the present civil revision petition for a direction to the learned Principal District Judge, Chengalpattu to dispose of the suit in O.S.No.283 of 2019 within the stipulated time that may be fixed by this Court.

5. Heard the learned counsel for the petitioner and perused the materials available on record.

Taking note of the facts and circumstances of the case, the learned Principal District Judge, Chengalpattu is directed to dispose of the suit in O.S.No.283 of 2019 as expeditiously as possible, preferably within a period 12 months from the date of receipt of a copy of this order and file report before this Court, after disposal of that suit. The parties concerned are directed to co-operate for trial, without getting any unnecessary adjournments.

7. Accordingly, this Civil Revision Petition is disposed of with the above direction. No costs.
