PRAYER The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the 3 rd respondent to issue a Community Certificate to the Petitioner identifying her as belonging to the Hindu Vanniyar Community (MBC) in the Union Territory of Puducherry, based on her birth and parents from Tamil Nadu, within a reasonbale time as fixed by this Hon'ble Court.

ORDER

(Order of the Court was made by J.NISHA BANU J.) The present Writ Petition is filed for the issuance of Writ of Mandamus directing the 3 rd respondent to issue a Community Certificate to the Petitioner identifying her as belonging to the Hindu Vanniyar Community (MBC) in the Union Territory of Puducherry, based on her birth and parents from Tamil Nadu, within a reasonbale time that may be fixed by this Court.

2. It is the case of the petitioner that the parents of the petitioner originally hail from the state of Tamil Nadu and have permanently settled in Puducherry for several decades. Both of them are holders of valid community certificate issued by the Tamil Nadu Revenue Authorities, certifying them as belonging to the "Hindu Vanniyar" community. The petitioner got married to one Ganesan, who is also a native of Puducherry, and he also belongs to the

same community. In this circumstance, the petitioner made a representation dated 02.04.2025 before the third respondent for issuance of a Community Certificate, but, the 3 rd respondent had not issued the same on the ground that the petitioner's parents' certificates are issued in Tamil Nadu. Challenging the same, the present Writ Petition is filed.

3. Heard the learned counsel appearing for the petitioner and Mr.V.Vasanthakumar, learned Additional Government Pleader (Pondy) appearing for the respondents.

4. Though the petitioner has sought for larger relief, the learned counsel for the petitioner would state that it would be suffice, if the respondents consider the representation of the petitioner and pass orders, within a reasonable time.

5. Considering the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, even though larger relief is sought for, we deem it fit that it would suffice to direct the respondents to consider the petitioner's representation dated 02.04.2025 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner and also affording her an opportunity of personal hearing. Such exercise shall be done by the respondents within a period of eight

(8) weeks from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
