The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 417, 294(b) & 506(ii) of IPC, in Crime No.22 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had love affair with the victim girl. Under the pretext of marriage, the petitioner had physical relationship with the victim girl. Due to which, the victim girl became pregnant. Thereafter, the petitioner refused to marry the victim girl. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further the petitioner has been falsely implicated in this case and hence he prays to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Additional Public Prosecutor submit that the petitioner under the pretext of marriage, had committed penetrative sexual assault and thereafter refused to marry the victim girl, hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the gravity of the offence committed by the petitioner, which is serious and heinous against the victim girl, this Court is not inclined to grant anticipatory bail to the petitioner.
