Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd respondent to dispose the pending appeal sent by the petitioner dated 17.07.2021 same was acknowledged on 20.07.2021 in accordance with law by conducting the enquiry and to issue a patta in favour of petitioner name in respect of the property situated to an extent of 3282 sq.ft in No.39, 5th Street, Kamaraj Nagar, comprised in Survey No.1/1, situated at Plot No.305, Paleripattu Village, Avadi Taluk and Chennai District and disposed the same within the time stipulated by this Court.

ORDER

This writ petition has been filed to issue a Writ of Mandamus, directing the 2nd respondent to dispose the pending appeal sent by the petitioner dated 17.07.2021, the same was acknowledged on 20.07.2021 in accordance with law by conducting the enquiry and to issue a patta in favour of petitioner name in https://hcservices.ecourts.gov.in/hcservices/

respect of the property situated to an extent of 3282 sq.ft in No.39, 5th Street, Kamaraj Nagar, comprised in Survey No.1/1, situated at Plot No.305, Paleripattu Village, Avadi Taluk and Chennai District, within the time stipulated by this Court.

2. The petitioner filed an appeal before the 2nd respondent as against the order passed by the 3rd respondent thereby rejected the request for issuance of patta for the reason that the subject land classified as Government poramboke meikkal and also its built area since situated nearby Chennai. However, the 2nd respondent after receipt of the appeal, did not pass any order.

3. Considering the above, the 2nd respondent is directed to dispose the appeal filed by the petitioner, after issuance of notice to the petitioner and counter parties, if any and after giving opportunity of hearing to them, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, this writ petition is disposed of. No costs.
