The petitioners namely R.Sakthivel, R.Suresh and R.Mahesh, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 294(b), 353, 332 and 506(ii) IPC r/w Section 4(1)(h) of TNP Act in Crime No.247 of 2023 on the file of the respondent police, seek anticipatory bail.

2. Learned counsel for the petitioners submitted that, petitioners are falsely implicated for the alleged offences under Sections 294(b), 353, 332 and 506(ii) IPC r/w Section 4(1)(h) of TNP Act in Crime No.247 of 2023. It is his further submission that, A1 was arrested and released on bail. 2nd petitioner is the President of Panchayat. Apprehending arrest at the hands of the respondent police, petitioners filed this petition.

3. Learned Government Advocate (Criminal side) opposes this petition, on the ground that, A1 namely Sakthivel was found with 6 bottles of MGM Diamond XXX rum. When police party effected the

seizure, petitioner scolded the police in filthy language and instigated the accused Suresh, Mahesh and Jeeva to attack the defacto complainant. Thereafter, accused beaten the defacto complainant with hands and threatened the defacto complainant that, they will kill him with beer bottle. On the basis of the complaint, first information report is registered. Therefore, he prays for dismissal of this petition.

4. Considering the nature and seriousness of the allegations made against the petitioner, and that petitioner had attacked the defacto complainant, who is a police officer and petitioner had made criminal intimidation, this Court is not inclined to grant anticipatory bail to the petitioner.

5. In the result, this Criminal Original Petition is dismissed. 12.07.2023 gd
