First appellant in the Second Appeal died.

2. C.M.P.Nos.195, 198 and 208 of 2022 are filed to condone the delay of 1731 days in filing the petition to set aside the abatement caused due to the death of first appellant in the Second Appeal; to set aside the abatement; and to substitute the petitioners 3 to 5 as appellants 3 to 5 in the Second Appeal, respectively.

3. First respondent in the Second Appeal also died.

4. C.M.P.No.210 of 2022 is filed to substitute the proposed respondents 4 to 7 as respondents 4 to 7, being the legal heirs of first respondent, in the Second Appeal.

5. Counsel has entered appearance for the proposed respondents 4 to 7 and he has no serious objection for allowing these petitions.

6. Having been satisfied with the reasons stated in the affidavits filed in support of the petitions and since there being no objection from the opposite side, I allow all these Civil Miscellaneous Petitions.

7. Registry is directed to carry out the amendment in the Cause Title and post the Second Appeal for hearing on 26.03.2024. dixit 01-03-2024
