Prayer: This Criminal Miscellaneous Petition has been filed under Section 482 of Cr.P.C. to modify the condition with respect to the deposit of the sum of Rs.5 lakhs to the credit of the crime number 20 of 2020, on the file of the respondent police in Crl.O.P.No.5863 of 2020 dated 16.09.2020.

ORDER

(This case has been heard through video conference) This Criminal Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.5863 of 2020, dated 16.09.2020, that the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.20 of 2020.

2. The learned counsel for the petitioner would submit that the petitioner is an employee drawing monthly salary of Rs.30,000/- however, the petitioner had given an undertaking, he is prepared to deposit a sum of Rs.5,00,000/- to the credit of Crime No.20 of 2020. He would further submit that the petitioner is an employee and due to covid pandemic situation, he was unable to raise the funds and he would seek for modification of the condition. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public Prosecutor would also submit that the petitioner has not complied with the condition imposed by this Court in Crl.O.P.No.5863 of 2020 dated 16.09.2020.

4. This Court had granted anticipatory bail to the petitioner only on the submissions made by the learned counsel for the petitioner, the petitioner is prepared to deposit a sum of Rs.5,00,000/- to the credit of Crime No.20 of 2020. Thereafter, the petitioner has not complied with the condition. Hence, this Court is not inclined modify the conditions.

5. Accordingly, this Criminal Miscellaneous Petition is dismissed.
