PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act to punish the respondent for wilful disobedience in not complying with the order dated 03.06.2022 passed by this Court in W.M.P.No.13182 of 2022 in W.P.No.13923 of 2022.

O R D E R

Through an interim order dated 03.06.2022, the order of transferring the petitioner from Nungambakkam to Pallavaram was stayed. Stating that the respondent is not accommodating the petitioner back at the original place, the present contempt petition has been filed.

2. Pending Contempt Petition, the respondent has accommodated the petitioner at his original place of his employment.

3. The learned Additional Government Pleader appearing for the respondent produced a Government Letter dated 09.11.2023, whereby, the period of service between 02.05.2022 and 02.06.2022 shall be treated as leave, for which, the petitioner was entitled.

4. In case, the petitioner is aggrieved against the same, liberty is granted to the petitioner to challenge the said proceeding in the manner known to the law.

5. In view of the compliance of the order passed by this Court, the disobedience alleged cannot be termed to be wilful in nature. Accordingly, the contempt petition is closed.
