Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to consider and pass orders on the petitioner's representation dated 11.03.2023 for initiating action against the encroacher by measuring the lands in S.Nos.143/9, 147, 149 and 150 at Kizhakkumedu Village, Severapoondi, Chetpet Taluk, Thiruvannamalai District and make a channel for the water to flow to the lake till the end without affecting the agricultural farmlands expeditiously in accordance with law.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) We have heard Mr.K.Balaji, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader, for the respondents.

2. The prayer is made to remove the encroachment.

3. The alleged encroachers are not parties to the Writ Petition. We cannot pass orders directing removal of encroachment in the absence of relevant parties.

4. Mr.P.Muthukumar, learned State Government Pleader, submits that the Tahsildar would make a survey and upon the survey being conducted, further action would be taken.

5. In view of the said statement, Writ Petition is disposed of. There will be no order as to costs.
