This petition has been filed to modify the condition imposed on the petitioner that he shall pay interim maintenance of a sum of Rs.12,000/- to the account of defacto complainant during first week of every English calender month until it is modified by any other court of law in the above Crl.O.P.No.30056 of 2022 dated 05.12.2022.

2. The learned counsel for the petitioner submitted that due to petitioner's ill-health, he is not going to any job and only his father is taking care of all expenses. So, he is not able to pay interim maintenance to the defacto complainant as ordered by this court. Hence, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable one, this Court is inclined to modify the condition that the 1/3

petitioner shall deposit the sum of Rs.10,000/- (Rupees ten thousand only) per month to the account of defacto complainant during first week of every English calendar month until it is modified by any court of law from the date of receipt of copy of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 30056 of 2022 vide order dated 05.12.2022 shall remain unalterted.
