Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for a writ of Certiorarified Mandamus to call for records relating to the impugned order passed by the respondent herein in his proceedings R.C.No.6776/A1/2015 dated 14.06.2016 and quash the same and consequently direct the respondent to reinstate the petitioner into service, within a time frame.

ORDER

This Writ Petition has been filed challenging the impugned order passed by the respondent herein in his proceedings R.C.No.6776/A1/2015 dated 14.06.2016 and quash the same and consequently direct the respondent to reinstate the petitioner into service, within a time frame.

2. Mr.V.Kadhirvelu learned Special Government Pleader accepts notice for the respondent.

3. By consent of both sides, this Writ Petition is taken up and disposed of at the stage of admission itself.

4. The grievance of the petitioner is that pursuant to the audit objection, a disciplinary proceedings have been initiated against the petitioner and he was put under suspension from 14.06.2016. In the meanwhile, morethan two years elapsed but order of suspension has not been reviewed. Hence, the petitioner has come up with this Writ Petition seeking to quash the order of suspension and for a direction to the respondents to reinstate him into service. However, when this writ petition is taken up,the learned counsel for the petitioner submits that present writ petition may be disposed of giving liberty to the petitioner to make a representation to the respondent with a prayer to review the order of suspension and on receipt of the same, the respondent be directed to consider and dispose of the same within a stipulated period in accordance with law, as per the direction of this Court., but in light of the law laid down in the case of Ajay Kumar Choudhary Vs. Union of India and another (2015) 7 SCC 291).

4. The learned Special Government Pleader who accepts notice for the respondents sought time to get instructions.

Considering the above facts and the submissions made by the learned counsel on either side and without going into the merits of the case, this writ petition is disposed of, giving liberty to the petitioner to submit a representation to the respondent, if so advised within a period of three weeks from the date of receipt of a copy of this order and on receipt of the same, the respondent shall consider the same in light of the law laid down in the case of Ajay Kumar Choudhary Vs. Union of India and another (2015) 7 SCC 291 and pass appropriate orders on merits and in accordance with law within a period of six weeks on receipt of such representation. No costs.
