PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to give and provide supply of electricity to the premises bearing Survey No.138/4 of Kodiyalam Village, Opposite TNEB, Bagalur, Hosur Taluk of LT power of 63 HP and 1 Kilowatts power for lighting connection to the petitioner company and further prays that respondent may be directed to pay penalty to the petitioner at the rate of Rs.1,000/- per day from 09.12.2008 till electricity is made available to us, as specified under section 43(3) of the Electricity Act, 2003.

The relief sought for in the present writ petition is to direct the respondent to give and provide supply of electricity to the premises in Survey No.138/4 of Kodiyalam Village, Opposite TNEB, Bagalur, Hosur Taluk.

2.The learned Standing Counsel appearing on behalf of the respondent Electricity Board made a submission that the vendor to the petitioner was a defaulter and has not settled the electricity charges. Thus, the Board authorities insisted to clear the arrears of the electricity charges to be paid by the vendor of the petitioner enabling them to consider the application submitted by the petitioner for providing electricity service connection in respect of the premises. 3.This Court is of the considered opinion that in the event of any arrears of electricity charges to be paid, the said amount is to be settled for submitting the application to transfer the service connection or to provide a fresh electricity connection in the same premises.
This being the Rules in force, the petitioner has to take necessary steps to collect the arrears and deposit the electricity charges to be paid by his vendor or settle himself for the purpose of availing the benefit of electricity connection. It is needless to state that the terms and conditions for considering the application is to be complied with and in the event of complying with the terms and conditions stipulated for the purpose of providing electricity connection, the case of the petitioner is to be considered in accordance with law. Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs.
