The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 448, 427, 294(b), 506(1) IPC and 4 of Tamil Nadu Prohibition of harassment of Women Act, 2002 in Crime No.131 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No.131 of 2023 for the offences under Sections 448, 427, 294(b), 506(1) IPC and 4 of Tamil Nadu Prohibition of harassment of Women Act, 2002. Petitioner is innocent. Apprehending arrest at the hands of the respondent, this petition is filed.

3. Learned Government Advocate (Criminal side), opposes on the ground that, petitioner used to park his two wheeler in front of the defacto complainant's house. The defacto complainant asked the petitioner, not to park the vehicle, in front of his house. On 06.06.2023 at

about 10.30 p.m., petitioner had jumped the compound wall and trespassed into the house of defacto complainant and broke open the glass window and scolded the defacto complainant in filthy language. Not only that, petitioner removed his dress and behaved in unparliamentary and indecent way. The investigation in this case is pending. Thus, he prays for dismissal of this petition.

4. In nature of the allegations made against the petitioner and the offence is said to have committed against 73 years old helpless and hapless woman and that investigation in this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 13.07.2023 gd
